These personal data processing principles (hereinafter referred to as "Principles") provide you with information about the categories of personal data we process about you, the purposes and extent of such processing, what authorizes us to do so, and for how long we are authorized to process it.

Purposes of Processing Personal Data

Your personal data may be processed by the Administrator for the following purposes:

  • Fulfillment of a contract, including its conclusion (contracts for the provision of legal services or fulfillment of client requests, i.e., actual performance of legal services according to legal regulations governing the practice of law; relationships with business partners, such as partner law firms or suppliers of products and services);
  • Fulfillment of legal obligations (especially obligations under accounting and tax legislation, i.e., providing personal data to tax authorities, and possibly other public authorities in accordance with applicable legal regulations; proper management of a lawyer's file, including email communication, contact lists, and services provided);
  • Sending commercial communications, offering services and products, and targeted advertising (ELEMENTZ LEGAL may send commercial communications or newsletters, especially in the field of law and business, and offer services via email; data obtained during visits to the Website may also be used for targeted advertising);
  • Protection of the legitimate interests of the Administrator (protection of the rights and legally protected interests of ELEMENTZ LEGAL, such as client identification under Act No. 85/1996 Coll., on Advocacy, and Act No. 253/2008 Coll., on Certain Measures against the Legalization of Proceeds from Criminal Activity);
  • Protection of the legitimate interests of third parties (especially clients) in accordance with rules governing the practice of law;
  • Handling requests submitted via electronic forms on the Website.

Personal data is processed by the Administrator both manually and automatically. Automated processing of personal data occurs primarily for the purpose of contract fulfillment and service offering.

Processing of Personal Data Based on Consent

If you grant ELEMENTZ LEGAL consent to process your personal data for the purpose of sending personalized marketing messages, through email or phone contact, you acknowledge that providing this consent is voluntary and that you can revoke the consent at any time in writing to the address of ELEMENTZ LEGAL or through the link provided in the commercial message email. The consent is granted until revoked. The refusal to grant consent does not affect the performance of the contract.

Recipients of Personal Data

ELEMENTZ LEGAL only discloses your personal data to authorized persons, but always to the extent necessary to fulfill the individual purposes of processing and based on the appropriate legal basis for the processing of personal data.

Personal Data of Third Parties

Personal data of third parties, including personal data of employees and customers of clients or suppliers of the Administrator, and other individuals involved in cooperation with the Administrator, or other data received by the Administrator from clients or suppliers in connection with the conclusion or performance of a contract, will be processed in accordance with applicable data protection laws. The Administrator will use this personal data for the purpose of fulfilling contracts with clients or suppliers. The Administrator will process personal data of third parties for the duration of the contractual relationship and for the period specified by special legal regulations, if applicable. They will be stored for a longer period if there is a justified need to retain the data in connection with a specific case.

These rights include (i) the right to access personal data, (ii) the right to rectify inaccurate and incomplete personal data, (iii) the right to erasure of personal data if they are no longer necessary for the purposes for which they were collected or otherwise processed, or if they were processed unlawfully, (iv) the right to restrict the processing of personal data, (v) the right to data portability, (vi) the right to object, after which the processing of personal data will be terminated unless compelling legitimate grounds for the processing are demonstrated, particularly in cases of potential legal claims, and (vii) the right to lodge a complaint with the Office for Personal Data Protection.

Right to Access Personal Data: If you want to know if ELEMENTZ LEGAL processes your personal data, you have the right to obtain information about whether your personal data is being processed and, if so, you also have the right to access your personal data.

Right to Rectification of Inaccurate and Incomplete Personal Data: If you believe that ELEMENTZ LEGAL processes inaccurate or incomplete personal data about you, you have the right to request their rectification and completion. ELEMENTZ LEGAL will rectify or complete the data without undue delay, always taking into account the technical possibilities.

Right to Erasure: If you request erasure, ELEMENTZ LEGAL will erase your personal data if (i) they are no longer necessary for the purposes for which they were collected or otherwise processed, (ii) the processing is unlawful, (iii) you object to the processing and there are no overriding legitimate grounds for the processing of your personal data, or (iv) there is no legal obligation to process them under EU law or national legislation.

Right to Restrict Processing of Personal Data: If you request the restriction of processing, ELEMENTZ LEGAL will make personal data inaccessible, temporarily remove or store them, or perform other processing operations necessary for the proper exercise of the right.

Right to Data Portability: If you wish ELEMENTZ LEGAL to transfer the personal data processed about you in electronic form, based on a contract or consent, to a third party, you can exercise your right to data portability. If the exercise of this right would adversely affect the rights and freedoms of others, ELEMENTZ LEGAL will not be able to comply with your request. You will be informed about such a decision.

Right to Object: You have the right to object to the processing of personal data that is processed for the performance of a task carried out in the public interest or in the exercise of official authority or for the purposes of the legitimate interests pursued by ELEMENTZ LEGAL.

If ELEMENTZ LEGAL fails to demonstrate compelling legitimate grounds for the processing that override your interests, rights, and freedoms, the processing based on the objection will be terminated without undue delay. In case of repeated or manifestly unfounded requests to exercise the above-mentioned rights, ELEMENTZ LEGAL is entitled to charge a reasonable fee for the realization of the right or refuse its realization. You will be informed about such a procedure.

NOTICE: Due to the specific nature of ELEMENTZ LEGAL's activities (provision of legal services), the exercise of certain rights of data subjects may be significantly limited (especially in cases of processing personal data related to specific legal cases).
